Dragonborn requires you to have started the Horn of Jurgen Windcaller quest. Once the Dragonborn has joined the Imperial Legion, only one more opportunity remains to switch sides, leaving the Legion for the Stormcloaks. When the Jagged Crown has been acquired, the Dragonborn can choose to travel to Windhelm where they can give the crown to Ulfric Stormcloak instead.
Its impossible to lose this quest unmodded unless you die. Just sit at the gate and go have some cereal, or maybe go to work. Come back and you will always win. Killing Balgruuf, for instance, will break the Main Quest, the Civil War Quest, the miniquest involving the peace conference, and a Daedric quest, to say nothing of the Whiterun thane quest.
Yes and no. You can kill all the guards, but they eventually respawn. Mine took about a month in game to respawn. You should reload a previous save, or try to talk and serve your jail time.
